How Do You Go About Holding A Same Sex Legal Marriage

To every person, marriage is a crucial step of life. This is because it affects both private and public life in many ways. Getting married in a same sex legal marriage is difficult due to numerous controversies surrounding same gender unions.

Gay and lesbian marriages face both support and criticism from world over. Those for this believe that everyone has a right to choose who to spend their life with. Those against claim that it goes against the moral and religious concerns and that it brings a different type of family setting. Regardless, the contemporary society is increasingly finding these types of couples acceptable. With this trend, it will not take a long time before their marriages become recognized.

Only some parts of the world recognize unions of similar gender. In other parts it is illegal while others have not yet made their stand. Some of the states in the US have legalized these unions either by popular votes, acts of the legislature or courts. Some states however have completely illegalized them through statutes and constitutions.

Some states however provide for these unions somewhat through civil unions or domestic partnerships. This is a legal framework to recognize gay and lesbian nuptials although not giving the full perks of a union between two people. This is hugely protested by the gay and lesbian rights movements saying that it is second class citizenship and abuse of their rights.

In the states that recognize same sex nuptials, the process of marriage is easy. You must first apply to get a license for a civil marriage. This is at a courthouse or city hall. If your religion allows it then you may choose to get married in your religious set up. The first step is making sure that you and your partner are eligible. This includes being of age and not related by blood.

This is followed by submission of an application form and also a fee for processing. When a few days have passed usually three, you will receive the license. This means that you are now free to solemnize your matrimony through a ceremony. When the wedding is complete, officiating individual signs the license and indicates time and place of wedding. The license is then sent to the court where it was issued.

When you do not live in the same country or state where you were married there are issues bound to arise. For instance, since the government does not recognize you as a couple it becomes difficult to access services meant for couples. Besides, if seeking to terminate your union it would get complicated since it is not recognized in the first place.

Many legal problems face same sex couples. For instance, it would be difficult to adopt children in a state that does not recognize parents of similar gender. It is prudent to contact a lawyer when thinking about getting married to avoid getting on the wrong side of the law.
